This is a legal agreement between You (hereinafter "You", "Client" or "User") and Equidem Management (hereinafter "We", "Us", "Company", "Equidem Management" or "Equidem"). By accessing and using this website and using any of the Services ("Services"), You signify Your consent, agreement and understanding of Equidem's Terms of Service and Privacy Policy. If you do not agree to the Terms of Service or Privacy Policy, please refrain from using equidem.com.

Definitions.

• "Information" means the information You provide to Equidem, when You apply for a loan or complete registration as an investor.
• "Site" shall be the website: equidem.com
• "Privacy Policy" means the Company's Privacy Policy which you can view by clicking on the link at the bottom of the equidem.com home page.
• "Capital User" is the natural person who accesses the investment service provided on equidem.com
•  "User Presta Fácil" is the natural or legal person who accesses the loan service provided by equidem.com 

General Terms of Service Overview

Equidem Management is a high-end real estate debt services company, founded in 2011 in Atlanta, Georgia, that seeks to connect those who borrow money to finance their projects (hereinafter referred to as Easy Lender User) with those who seek investment options to earn good returns (hereinafter referred to as Capital User).

The following is a brief summary of certain terms and conditions contained in these Terms of Service. "The Service" shall mean any use of equidem.com.

However, it is important to mention that this summary is provided for your convenience only; therefore, you must read the entire Terms of Service to use equidem.com.

• To use the Service, you must agree to these Terms of Service and the Privacy Policy.
• We reserve the right to change these Terms of Service at any time without notice. In the event of a material change, we will use reasonable efforts to notify you.
• The service includes security and tampering related features which, if activated, may cause content previously available for use to thereafter become unavailable for use.
• The user must be at least 18 years old to access our service.
• By using the service, you consent to the collection, processing and use of all information related to your use of the service, which is collected and handled in accordance with our Privacy Policy.
• The information related to the terms of validity and availability of the services are available on equidem.com. The Company limits its liability with respect to the same.

Use of the site

The user must be at least 18 years of age to use the service and agree to these Terms of Service and the Company's Privacy Policy, which may be amended from time to time as described in Section (I).

As a user of the site to use any of our Services, you agree to the following: 

1. Exclusive Use. By accepting these Terms of Service, you are granted a limited, exclusive, non-transferable, non-sublicensable, non-sublicensable right to enter, access and use the Service. In that regard, You acknowledge that Equidem is not responsible for third party access to the Service as a result of the theft or misappropriation of your username and passwords.
2. Information submitted. By agreeing to these Terms of Service, you are only responsible and liable for the Information and content you provide through your use of the Site and Services; the information and content you make available in any manner through the Services.
3. Assumption of Risks and Precautions. By agreeing to these Terms of Service, you assume all risks when using the Services.
4. Other Services and Products: By accepting these Terms of Service, Equidem may offer the Client other Services and products that meet the Client's needs directly or through third party Affiliate Partners. Equidem may provide the Easy Lending User's information to the Capital User with the prior consent of the Easy Lending User.
5. Quality of Information. By agreeing to these Terms of Service, You agree to provide accurate, true, current and complete Information to access the Services.
6. Lawful Purpose. By agreeing to these Terms of Service, you agree not to use the Site or the Services for any unlawful purpose. You will only use the Site or the Service in accordance with federal, state and local laws.

Property Rights

By agreeing to these Terms of Service, you acknowledge and agree that Equidem owns and has all rights to the Site and the Services. You may not copy reproduce or distribute in whole or in part the Service or the contents of the Site.

All text, graphics, logos, sounds and artwork on the Service, including but not limited to the design, structure, appearance, layout of the content of the Site; are the property of Equidem and are protected by copyright, intellectual property laws and these Terms of Service. 

Application for a loan

By completing a loan application, you certify that all information is true and that you have not made any false statements on it or any other document, nor have you omitted any pertinent information. Any fraudulent information will automatically disqualify your loan application.

For its part, Equidem Management is entitled to a full loan review process. This may include verifying the information on this application with employers, vendors, financial institutions, credit reporting agencies and others as required.

The loan applicant confirms that this hard money loan is for investment purposes only and does not involve the borrower's primary residence. This loan is not for consumption purposes, but for investment purposes only.

The company cannot grant the loan if there is any inconsistency with the terms agreed and established in the promissory note, even on the closing day. The company reserves the right to disburse the loan already approved, due to legal situations, public health policies and any other factor that is considered risky for the operation.

User Information 

By agreeing to these Terms of Services, the Information you provide to us, including your personal and business information, you have a perpetual, irrevocable, royalty-free license to: reproduce, adapt, edit, modify, translate, publish, transfer and/or distribute any of your content. This license specifically includes the right to make such content available to other trusted companies, organizations and/or individuals with whom Equidem has a business relationship to carry out the performance of the Services.

Communication and privacy.

By agreeing to these Terms of Services, the Company may use your email address to send you messages notifying you of important changes to the Services or special offers. In addition, we may contact you by telephone, send you voice messages or send you text messages (SMS) if you voluntarily provide us with your telephone number, in order to communicate with you about the Services.

Limitation of Liability.

By agreeing to these Terms of Service, you understand and agree that use of the service is at your sole risk and that, except as set forth in these Terms, the service is provided "as is" and without warranty of any kind by the company or its affiliates. The Company does not warrant or make any representations regarding the use or the results of the use of the service with respect to performance, accuracy, reliability, security, capacity, timeliness or otherwise. Under no circumstances shall the Company or its affiliates be liable for the unauthorized use of any content or any use of the Service to develop, distribute or use any material that is defamatory, libelous, slanderous, libelous or obscene, that gives a false impression of any person, that constitutes an invasion of any right of privacy or an infringement of any right of publicity, that violates or infringes the rights of any third party or that violates any foreign, federal, state or local law or regulation. Some jurisdictions do not allow the exclusion or limitation of implied warranties or liability for incidental or consequential damages, so such exclusions or limitations may not apply to you. To the extent that, in a particular circumstance, any statutory disclaimer or limitation on damages or liability set forth herein is prohibited by applicable law, then, in lieu of the provisions hereof in such particular circumstance, the Company shall be entitled to the maximum disclaimers and/or limitations on damages and liability available at law and in equity by such applicable law in such particular circumstance. 

Duration and termination

This Agreement is effective upon your use of the Site and Services, and shall remain in effect indefinitely unless terminated hereunder. You may cancel your registration for any of the Services at any time during the term of such registration or subscription by emailing us at info@equidem.com or by calling us at 404-445-8448.

Modifications to these Terms

Equidem reserves the right, and sole discretion, to modify the Terms of Service and Privacy Policy from time to time. In doing so, the User will be notified in accordance with applicable law.
